Welcome to the Kaplan Nurse Opportunities Database (the "Database") designed for qualified international nurses who wish to explore  employment opportunities at healthcare facilities in the United States.

Please read these Terms carefully before submitting your information to become part of the Database. These terms, together with the Terms of Use and the Privacy Policy govern your use of the Database (collectively “Terms”) and constitute a legally binding agreement between you and Kaplan. By continuing to  access the Database, you agree to be bound by the Terms then in effect. Specifically, you agree to be bound by the  terms set forth below.

1. Purpose of the Database 

  • Connecting Opportunities: The Database allows you to showcase your skills, credentials, and experience to potential U.S. healthcare  facilities seeking to hire international nurses. 
  • No Guarantee of Job Placement: The Database is a free, digital talent-matching platform and information-sharing ecosystem. Inclusion in this Database does not guarantee job placement, interviews, visa sponsorship, or employment offers. 
  • Commission for Referrals : Healthcare facilities that search for nurses in Kaplan’s Database may  compensateKaplan for hosting this talent-matching service and for connecting you to them.
  • Not an Employment Agency: You acknowledge that Kaplan is not an agent,  employment agency or personnel placement service. Kaplan does not make any hiring decisions nor exercises any control over the healthcare facilities who chose to use the Database. 

2. Database Usage, Profile Masking, & Re-Identification Risk

You are permitted to submit information for use in the Database for your personal, non-commercial purpose of seeking employment. You authorize Kaplan to use any information you choose to submit and any accompanying uploaded documents (your “Profile”) in accordance with Kaplan’s privacy policy and in the following ways listed below:

  • Internal Validation: Before any of your information is shared, it will be reviewed and validated by internal Kaplan employees to ensure the profile is complete.
  • Masked Healthcare Facility or Hospital Review: Once validated, your profile will be shared with potential hospital partners through a secured application. To protect your privacy, your direct personal identifiers (such as your full name, email address, and exact location) will be hidden from initial view. US healthcare facilities will review your profile based on your expertise, credentials, and qualifications.
  • Re-Identification Warning: While Kaplan obscures your direct personal identifiers during the initial review phase, you acknowledge that the specific, unique combination of your clinical history, graduation timeline, and specialized certifications may allow potential employers to infer your identity.
  • Full Information Sharing: Your full contact and identifying information will only be shared with a US healthcare facility for the purpose of recruitment  after a  potential match is verified by Kaplan staff.  The US healthcare facility may potentially review your profile and request to meet with you.
  • Active Engagement: Kaplan or the US healthcare facility may communicate with you from time to time about potential opportunities.   You are responsible for being actively engaged in the selection process and for fulfilling the recruiting steps and process requirements as requested by the US healthcare facility of interest.

3. Nurse  Responsibility, Profile  Accuracy, & Immigration Disclaimer

  • Veracity of Data: You certify that all information you submit as your Profile —including license numbers, clinical experience, certifications, and English proficiency scores—is accurate, truthful, and complete. Thereafter, you are responsible for keeping your Profile accurate and up-to-date.
  • Proactive Updates: You are responsible for keeping your credentials up to date. If your certification status changes or you gain new credentials, you must return to this form to submit your updated information.
  • No Immigration or Legal Advice: Any US work authorizations required is your and the US healthcare facility’s sole responsibility.  Kaplan does not provide legal, visa, or immigration advice or support. All visa processes, immigration compliance, and legal adjustments required to work in the United States must be discussed with the US healthcare facility interested in your Profile. .
  • Removal for Inaccuracy: Kaplan reserves the right to immediately and without notice remove any individual from the Database if it is discovered that they violate any of the Terms or provide inaccurate, incomplete, or misleading information.

4. Retention Period & Active Profile Maintenance

  • Active Retention Window: Subject to these Terms, Kaplan will  keep your Profile  active in the Database for a period of two (2) years from your last recorded interaction (e.g., initial form submission, profile update, or confirmation of interest) unless you request to delete the Profile earlier.
  • Annual Re-Verification: To ensure your Profile  remains accurate for US healthcare facilities , Kaplan will reach out to you via automated communication at least once per year to request that you review and refresh your credentials  displayed in the Profile. Every successful update or confirmation resets your 2-year retention window.
  • Deactivation for Inactivity: If you do not respond to an annual verification request or fail to update your Profile in a timely manner, Kaplan reserves the right to deactivate your Profile within the Database.

5. Communication, Non-Responsiveness, & Effects of Deactivation

Active communication is vital to remain engaged in the US healthcare facility’s recruitment process.

  • The 3-Contact Rule: If Kaplan attempts to reach out to you regarding potential employer  interest or Profile verification via your supplied email address more than three (3) times without a response, your Profile will be automatically deactivated.
  • Effects of Deactivation: While a Profile is deactivated, it is completely hidden from the secure application. US healthcare facilities will not be able to view your credentials, and your Profile will not be considered for any potential job matches or outreach. Kaplan is not liable for any missed employment, placement, or sponsorship opportunities..
  • Reactivation Process: If your Profile is deactivated due to non-responsiveness and you wish your Profile to be activated  in the Database, you must email the Kaplan Community Team at kaplancommunity.support@kaplan.com to have your account verified and reactivated. Profiles left deactivated and unverified for more than ninety (90) days may be permanently deleted.

6. Limitation of Liability & Disclaimer of Warranty 

  • No Liability for US Healthcare Facility  Actions: To the maximum extent permitted by law, Kaplan shall not be liable for any direct, indirect, incidental, or consequential damages arising out of your participation in this Database. Kaplan holds no responsibility or liability for the employer hiring decisions, employment practices, labor disputes, visa sponsorships, or workplace actions of the third-party US healthcare facilities.
  • IN NO EVENT SHALL KAPLAN, ITS PARTNERS, OFFICERS, EMPLOYEES, AGENTS, REPRESENTATIVES, SUPPLIERS OR CONTENT OR SERVICE PROVIDERS BE LIABLE FOR DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION, DIRECT, INDIRECT, COMPENSATORY, SPECIAL, INCIDENTAL, PUNITIVE AND CONSEQUENTIAL DAMAGES EVEN IF MADE AWARE OF THE POSSIBILITY OF SUCH DAMAGES, WHETHER IN AN ACTION UNDER CONTRACT, EMPLOYMENT, NEGLIGENCE OR OTHER THEORY, ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE DATABASE, INABILITY TO USE OR PERFORMANCE OF THE DATABASE AND/OR ANY CONTENT, MATERIALS OR SERVICES AVAILABLE THROUGH OR RELATED TO THE DATABASE. Some states do not allow the disclaimer or limitation of damages, so the disclaimers set forth above may not apply to you.
  • Disclaimer of Warranty. THE DATABASE, ITS CONTENTS AND THE SERVICES AVAILABLE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT REPRESENTATION OR WARRANTY OF ANY KIND. KAPLAN EXPRESSLY DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES, EXPRESS OR IMPLIED, OF ANY KIND WITH RESPECT TO THE DATABASE, ITS FUNCTIONALITY AND ANY RESULTING OPPORTUNITIES THAT MAY BECOME AVAILABLE TO YOU, INCLUDING BUT NOT LIMITED TO WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, ACCURACY AND FREEDOM FROM COMPUTER VIRUSES OR OTHER HARMFUL COMPONENTS. OUTPUTS FROM AI POWERED RESOURCES SHOULD NOT BE RELIED ON AS A GUARANTEE OR PROMISE ANY SPECIFIC OUTCOME. ARTIFICIAL INTELLIGENCE AND MACHINE LEARNING IS EVOLVING TECHNOLOGY AND MAY NOT PRODUCE ACCURATE OUTPUTS. Some states do not allow the disclaimer or limitation of warranties, so the disclaimers set forth above may not apply to you.

7. Withdrawing from the Database

You maintain full control over your Profile  and your decision to pursue any opportunity offered by the US Healthcare facility. 

  • Voluntary Deactivation : If you no longer wish to have your Profile shared  with US healthcare facilities , simply email the Kaplan Community Team at kaplancommunity.support@kaplan.com, and we will promptly remove your Profile from the Database.
  • Secured a Job : If you successfully secure employment or are no longer seeking employment opportunities , please contact the Kaplan Community Team at kaplancommunity.support@kaplan.com so we can  remove your Profile  from the active Database.

8. General Legal Provisions

  • Minimum Age & Legal Capacity: By submitting this form, you certify that you are at least eighteen (18) years of age and possess the legal capacity to enter into this binding agreement.
  • Sanctions & Export Compliance: You warrant and represent that you are not located in a country subject to a U.S. Government embargo or trade sanction, and that you are not listed on any U.S. Government list of prohibited or restricted parties (including the OFAC Specially Designated Nationals list). If you fall under any such restriction, Kaplan reserves the right to terminate your account immediately.
  • Mandatory Arbitration & Class Action Waiver:. Any and all disputes arising from or related to this Terms or the Database service, including whether the dispute is arbitrable and the scope of this arbitration agreement, shall be finally resolved by arbitration administered by a single arbitrator under the then-applicable rules of the American Arbitration Association (as modified herein) in accordance with the Federal Arbitration Act. The arbitration shall be governed by and construed by federal law to the fullest extent possible. Unless otherwise agreed by the parties, the arbitration shall take place in the largest U.S. city within 100 miles of your permanent residence.  If You reside outside the United States, then the arbitration shall take place in accordance with the American Arbitration Association Consumer Rules and Protocol. Judgment on the arbitral award may be entered in any court having jurisdiction thereof.

To the maximum extent permitted by law, should You wish to initiate a legal action against Kaplan in arbitration, You waive any right or ability to be a class or collective action representative or to otherwise participate in any putative or certified class, collective or multi-party action or proceeding based on such a claim in which Kaplan or a related entity is a party. The same applies to Kaplan's legal actions against You. Thus, You and Kaplan agree that each may bring claims in arbitration against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class. Further, unless both You and Kaplan agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over a representative or class proceeding.

  • Governing Law & Jurisdiction: These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles. For any dispute not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Fort Lauderdale, Florida.
  • Modifications to Terms: Kaplan reserves the right to modify or update these Terms and Conditions at any time. Any changes will be effective immediately upon posting the updated terms on our platform. Your continued Profile  in the Database after such changes constitutes your acceptance of the new Terms.
  • Entire Agreement: These Terms constitute the entire agreement between you and Kaplan regarding the Database and supersede all prior or contemporaneous oral or written communications, promises, or representations.
  • Severability: If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions.
